Contest Rules

1. INTRODUCTION
This document describes the official rules of the Fox Tango FT-857D Contest organized by Fox Tango International an on line Amateur Radio Club. The object of this contest is to give something back to our club members who support the club while at the same time possibly building up funds for or primary club project that of maintaining the Fox Tango Club Radio Graveyard and providing parts to Fox Tango members around the world which would otherwise no long be available to them.
2. DEFINITIONS
"Entrant" Person or persons, He or She who makes a donation to the club to enter the contest.
"Sponsor" means the Fox Tango International Amateur Radio Club
"Overtime Rule" the sponsor reserves the right to
extend the contest for an additional 31 days not to exceed 11:59
p.m. ET on March 31st 2006 if for some unforeseen reason the
club has not recouped the purchase price of the transceiver,
this will be known as "Overtime Rule." allowing the club and
it's sponsors additional time for contest entries.

Participation constitutes Entrant's full and unconditional agreement to and acceptance of these official rules.
4. ELIGIBILITY
The Contest is open only to individuals who are at least 18 years of age. All Fox Tango club members as well as any one interested in amateur radio is allowed to participate in the contest with the exception of the club administrator and the person or persons who will be designated to draw the winning ticket, are not eligible to participate. The Contest is subject to all national, federal, state and local laws and regulations. These official rules are void where they are prohibited or restricted by law or regulation.
5. CONTEST PERIOD The Contest runs from 12:00 a.m. ET, December 1st, 2005 through 11:59 p.m. ET, February 28th, 2006.
PLEASE NOTE, however the sponsor reserves the right to extend the contest for an additional 31 days not to exceed 11:59 p.m. ET on March 31st 2006 if for some unforeseen reason the club has not recouped the purchase price of the transceiver, this will be known as the "Overtime Rule." Winner will be announced March 1, 2006 unless "Overtime Rule" is applied and then the winner will be announced April 1st 2006 on the Fox Tango Yahoo Forums and clubs official web site http://www.foxtango.org
6. HOW TO ENTER
To enter the Contest, the Entrant must submit an official entry to the club either by mail or by means of the Pay Pal donation button provided. If submitting by mail send a clearly printed entry form completed with, among other information, your name, address, city, state, zip, phone number and email address. If using the Pay Pal button for your club donation this will be considered as an official on line entry with, among other information, your name, address, city, state, zip, phone number and email address. Entries must be submitted online by 11:59 p.m. Eastern Time on February 28, 2006. Each contestant must be the authorized account holder of the email address submitted in connection with that Contestant's Entry. The authorized account holder is the natural person who is assigned to the email address by an Internet access provider, online service provider, or other organization that is responsible for assigning email addresses or the domain associated with the submitted email address.
7. SELECTION OF WINNER
All entries will be combined into one basket and a winner will be drawn by a third party outside of the Fox Tango club on February 28, 2006 (Unless the over time rule has been declared) at which time the official drawing will be 31 days later on March 31st 2006. The winning ticket when drawn will be final, the winner will be required to permit the use of his/her name and identity in connection with the promotion of the Contest so we can announce the winners identification.. If a winner does not respond within fifteen (15) days after the date of winning notification, or in the event of non-compliance with any of these official rules, the prize will be forfeited, and a new ticket will be drawn and deemed the winner.
8. PRIZE

9. WARRANTIES
Original manufacturer warranty (One full year from Yaesu) less any warranty time lost during the contest at which time the transceiver was in the possession of the club, during and up until the end of the contest. if the winner is outside of the United States and you have problems with warranty service (Hopefully it won't be needed) the club will attempt to forward the rig to Yaesu U.S.A. if necessary at your expense. However keep in mind the club will make no warranty, representation or guarantee of any kind.
10. DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
By participating in the Contest, the Entrant agrees to be bound by these official rules, including all eligibility requirements and all decisions of the Sponsor. By participating in the Contest, the Entrant agrees to indemnify and hold harmless the Sponsor and its officers, moderators from any and all liability, claims, or actions of any kind, including, without limitation, property damage, personal injury, and/or death, arising out of his/her (i) breach of any representation, warranty or covenant contained in these official rules, or (ii) participation in the Contest; or (iii) acceptance and/or use or misuse of any prize in connection with the Contest.
BY PARTICIPATING IN THE CONTEST, THE ENTRANT AGREES THAT THE SPONSOR ENTITIES MAKE NO WARRANTY, REPRESENTATION, OR GUARANTEE OF ANY KIND, EXPRESSED OR IMPLIED, IN FACT OR IN LAW, RELATING TO THE CONTEST AND/OR THE PRIZE.
11. TRADEMARK INFORMATION
The names Yaesu, as well as the Yaesu logo are all registered trademarks of the Yaesu company http://www.yaesu.com Any use of those or any other sponsor trademark, Fox Tango logo must comply with the club policy.
12. PRIVACY
Except as otherwise stated herein or as otherwise agreed by Entrant and Sponsor, the information communicated by the Entrant in connection with Entry to the Contest will be used for the sole purpose of this Contest, and will not be communicated to third-parties.
13. IDENTITY OF WINNERS
The winner of the club FT-857D transceiver will be announced by E-mail to the membership on the primary Fox Tango user form on Yahoo Groups as well as all other F.T. forums. If you are not signed on to one of the forums at the time the winner is announced you may send a self-addressed, stamped envelope to "Fox Tango International 1427 Forest Ridge Dr. Stanley N.C. 28164-7724 USA" Requests must be received (not postmarked) by March 31, 2006.
14. AMENDMENT; WAIVER
Sponsor may only amend the official rules in order to apply the "Overtime Rule" and sponsor may not cancel the contest once started.
15. FINALLY
All prizes will be awarded. No prize
transfers or substitutions. No substitutions will be made
for cash value of the transceiver. All taxes and custom
taxes are the responsibility of the winner.
This contest is subject to federal, state and local regulations
and laws, and is void where taxed, restricted or prohibited.
